Each villa is personally inspected and accurately described on our website. All advertised villas are under contract with MY LUXORIA and have rental licenses from the state authorities. Our team is available 24/7 to provide our clients with the best service. MY LUXORIA cares about comfort and tends to the specific needs of all our guests individually, and we’re therefore offering you the best you could possibly get. Our offer is specially designed for guests who prefer a more authentic and personal way of traveling, and we fully believe that there is the perfect accommodation for every single guest of ours.

1. CONTRACT

The rental contract you enter into as a lessee with MY LUXORIA as an agent, is actually concluded with the villa owner as a lessor. MY LUXORIA acts exclusively as an agent and it shall be liable only as an agent. By making an advance payment for the reservation of the desired villa, you unconditionally accept these General Business Terms and Conditions. MY LUXORIA reserves the right to change these General Conditions, which will be published on MY LUXORIA's website www.myluxoria.com and will be effective from the date of publication on. All annexes to the Rental contract are only valid if made in writing. MY LUXORIA will send a written reservation confirmation to the guest once the reservation advance payment is received. A written reservation confirmation, together with these General Business Terms and Conditions, make a Rental contract between the guest as a lessee and the villa owner as a lessor. Guests must contact us immediately if any information appears to be incorrect, as changes may not be possible later.

2. PRICES AND PAYMENT


Credit card payments are made in euros (€). If a guest has a credit card in a different currency, a conversion to euros will be made by the guest’s credit card company. The reservation is binding, and an advance payment in the amount of 30% of the agreed accommodation price is required, after which the reservation is confirmed. After the advance payment is done, the contract with the owner is concluded and these General Business Terms and Conditions, which make a constituent part of the villa Rental contract, are accepted. MY LUXORIA will send a written reservation confirmation to the guest by email after the completion of the reservation process and payment, and it represents a Rental contract concluded with the owner. The Rental contract is considered concluded after MY LUXORIA receives the paid advance amount. Water, gas, electricity, internet, bed linen, towels, kitchen towels, final cleaning of the interior, maintenance of the swimming pool and exterior, registration of stay, residential tax, and value-added tax are all included in the rental price unless otherwise is indicated on the specific villa’s homepage.

The acceptable payment methods for advance payment are credit card (Master Card, Visa, Maestro, American Express, Diners, and Discover cards), Pay Pal, and bank transfer. The amount charged to the guest’s credit card will be in euros (€). If the guest has a different currency on his/her credit card, a conversion to euros will be made by the guest’s credit card company. As a result of this conversion, there may be minor differences between the price shown on our website and the price charged to the guest’s credit card. Payments made via bank transfer and PayPal are charged in euros, with no possibility of exchange rate differences. MY LUXORIA is not responsible for the exchange rate differences or fees imposed by other banking institutions.

All payment methods accepted for the advance payment are also acceptable for the balance payment (70% of the agreed accommodation price). The payment by credit card, Pay Pal, and bank transfer has to be done up to 30 days prior to the arrival date so that MY LUXORIA has enough time for forwarding the payment to the owner.

The following conditions shall apply to reservations made 30 days or more prior to the beginning of the rental period:

●    Advance payment (30% of the agreed accommodation price) is required immediately if the credit card or Pay Pal is selected as a payment option. If the payment via bank transfer is selected, MY LUXORIA must receive the paid amount within 3 (three) days.

●    Balance payment (70% of the agreed accommodation price) is required no later than 30 (thirty) days prior to the arrival date if payment is made via credit card, Pay Pal, or bank transfer. If it is permitted to pay the balance payment in cash (if this option is possible for the guest’s desired villa, the guest will be given the choice when making your reservation) guests are obligated to pay 70% of the agreed accommodation price immediately after arrival, directly to the owner. There is no possibility to pay electronically (credit cards/Pay Pal) in the villa.

The following conditions shall apply to reservations made 30 days or fewer prior to the beginning of the rental period:

●    The payment of the total amount is due immediately. The payment can be done by credit card, Pay Pal, or bank transfer. 

●    If the guest chooses to pay a part of the agreed accommodation price in cash (if this option is possible for the guest’s desired villa, the guest will be given the choice when making your reservation) the advance amount (30% of the agreed accommodation price) should be paid immediately). Guests are obligated to pay 70% of the agreed accommodation price immediately after arrival, directly to the owner. There is no possibility to pay electronically (credit cards/Pay Pal) in the villa.

The guest is obliged to make payments within the time frame and in the manner specified by this clause of the General Business Terms and Conditions. If the guest does not obey the payment due dates, the Rental contract is considered terminated without a notice period. MY LUXORIA is not obligated to inform the guest of this termination because it is considered a severe breach of the contract.


3. CANCELLATION AND CHANGES


Guests can cancel their reservation by writing an e-mail to MY LUXORIA. The cancellation is effective as of the day MY LUXORIA received the written cancellation notice and only under the terms of this Clause. If the Rental contract is cancelled, all payments received up to the cancellation date will be retained, and the guest is not entitled to a refund. 

In case the guest can find another guest as his substitute for the same reservation (same accommodation, same dates) and under the same conditions, MY LUXORIA shall transfer the Rental contract to a new guest (after receiving all necessary data about the new guest), and it shall send him/her a written reservation confirmation. MY LUXORIA will retain the previously received payment after the transferred contract, and the new guest is required to pay the balance up to the total accommodation price based on the previously selected payment method, which is an integral part of the contract.

If the guest is prevented from traveling, the reservation can be transferred to another person or period (if possible) in the same villa. If the reservation is moved to a more expensive period, the guest must pay the difference in price. If the newly chosen period is less expensive than the original, the total price remains unchanged. However, guests must notify MY LUXORIA of any changes no later than 42 days prior to their arrival date. If a guest wishes to make any additional changes to the reservation after it has been confirmed, the guest must notify MY LUXORIA as soon as possible.


4. ARRIVAL AND DEPARTURE


The guest will receive a reservation confirmation, and 15 days before their arrival date, they will also receive a check-in info e-mail with all necessary arrival and departure information (arrival and departure times, address, coordinates, and phone number of the host), which is non-changeable and must be followed.

In the event of an earlier arrival, the guest will be unable to enter the villa before the specified time of arrival. The guest must always check out of the villa by 10 a.m. on the departure day, and the keys must be returned to the owner. In the event of a later departure than agreed, the guest is obligated to pay the owner all additional costs, directly on the spot.


5. HOUSE ORDER


Guests are expected to follow the house rules. Each villa has its own house rules, which are displayed and available to guests. If guests do not follow the house order rules, it is considered a serious breach of the Rental contract terms, and the owner and/or MY LUXORIA have the right to terminate the Rental contract. The termination of the Rental contract shall be effective immediately, without notice, and the guest is obligated to leave the villa permanently, along with all other persons staying there, within 2 (two) hours. Guests are not entitled to demand a refund of the paid accommodation price from the owner or MY LUXORIA.

6. CAPACITY


The number of people who can stay in the villa and its surrounding premises cannot exceed the maximum allowed number of guests listed on each villa's homepage. Children of all ages are included in this number of guests. Children up to one year of age are excluded if their arrival is previously announced. After the lease begins, the guest is required to notify the owner about all visitors who come to visit him/her in advance. If more than the maximum permitted number of guests stay in the villa or its surrounding premises, without the owner's permission, the owner and/or MY LUXORIA retain the right to terminate the Rental contract, which comes into force immediately and without notice, and the guest is required to leave the villa permanently, along with all other persons staying there, within 2 (two) hours. Guests are not entitled to demand a refund of the paid accommodation price from the owner or MY LUXORIA.

7. YOUTH GROUPS


In case guests are under the age of 25, they must notify MY LUXORIA immediately at the time of the reservation of the exact number of guests and their ages. Guests under the age of 25 may make reservations only if MY LUXORIA permits it. MY LUXORIA and the owner reserve the right to reject groups of guests under the age of 25 if MY LUXORIA is not notified of their arrival, in which case the guests are not entitled to a refund of the paid accommodation price.

8. NOISE AND PARTIES


Guests are not permitted to hold parties in the villa or elsewhere on the property. If the guests disturb public order with noise and banter and do not calm down after being warned, this will be considered a severe breach of the Rental contract, in which case the owner and/or MY LUXORIA are authorized to terminate the Rental contract. The termination of the Rental contract shall be effective immediately, without notice, and the guest is obligated to leave the villa permanently, along with all other persons staying there, within 2 (two) hours. Guests are not entitled to demand a refund of the paid accommodation price from the owner or MY LUXORIA.

9. PETS


The ability to bring pets is clearly stated on the homepage of each villa, under the 'suitability'. 'Pets are allowed' or 'Pets are allowed with an extra charge' is indicated in pet-friendly villas. When booking a pet-friendly villa, guests should indicate on the reservation form whether or not they intend to bring a pet. For villas that charge a pet fee, the amount of the surcharge is listed next to the price list. The pet fee is paid in cash upon arrival unless otherwise agreed. Pets are only permitted in certain villas upon request. Before booking these villas, guests must contact MY LUXORIA, and reservations can only be confirmed after written approval If a guest wishes to bring more than 1 (one) pet, he or she must additionally contact MY LUXORIA, and he/she is not permitted to bring more than 1 (one) pet into a villa without written permission.

Pet owners are responsible for cleaning up after their pets, and pets are not allowed to sit on the furniture at any time. Pet owners must follow house rules. Any evidence of a pet's stay on the furniture may result in additional cleaning costs. All pets must be vaccinated against rabies and other illnesses in accordance with the current regulations. The guests are advised to use appropriate preventative measures to protect their pets from common illnesses.

Keeping pets in a villa is the sole responsibility of the guest, and the owners and MY LUXORIA accept no responsibility for any illness or injury that the pets may suffer during their stay. The pets are not allowed to access the swimming pools. 

Even though pets are not permitted in certain villas, neither the owner nor MY LUXORIA can guarantee that there were no previous pets in the house or that the owner has no pets. MY LUXORIA does not accept responsibility for allergic reactions that may occur in any of the houses. 

If the guest brings an unannounced pet, the owner and/or MY LUXORIA retain the right to terminate the Rental contract. The termination of the Rental contract shall be effective immediately, without notice, and the guest is obligated to leave the villa permanently, along with all other persons staying there, within 2 (two) hours. Guests are not entitled to demand a refund of the paid accommodation price from the owner or MY LUXORIA.


10. ENVIRONMENT


Guests should be aware that some of our properties are in rural or isolated areas, so you may encounter flora and fauna such as mosquitoes, wasps, ants, local dogs, and so on, as well as other environmental activities such as farming. MY LUXORIA is not responsible for any construction or road work that occurs near the property. MY LUXORIA will make every effort to notify you of any work that is going on, but work can happen at any time without our knowledge.

The guest is required to follow all instructions, especially those relating to the use of the swimming pool, issued by the owner or MY LUXORIA for his/her own safety. The guest is responsible for using a swimming pool. Children must not be present in the swimming pool area unless they are supervised by adults. The guest uses the swimming pool at his or her own risk.

If the accommodation is reserved outside of the summer season, the swimming pool or jacuzzi may be unavailable. Guests should be aware that using a jacuzzi is connected with certain health risks, and they should do so at their own risk. The water in the jacuzzi may not be warm until late in the evening on the arrival date. Standing on the jacuzzi lids is not permitted. The lids are not designed or adjusted to support a person's weight and are easily broken. If the lid is broken, the guest is obligated to compensate the owner directly.


11. TECHNICAL EQUIPMENT


Villas include all necessary devices, technical equipment, and other amenities to ensure a pleasant stay for the guests. The owner is responsible for ensuring that all devices in the villa work properly. In the event that any of the device’s malfunction or fail, the guest must notify the owner and/or MY LUXORIA so that MY LUXORIA can request that the owner arranges for the repair and removal of the failure as soon as possible. The owner is required to remove the reported failure within a reasonable time frame. The owner is completely responsible for the failures, and the owner should do everything possible to repair or remove the failures or other irregularities in the shortest possible time. If the guest wants to complain, the complaint is submitted to the owner of the house and not to MY LUXORIA agency.

12. SECURITY DEPOSIT


The guests are obliged to leave a security deposit upon arrival, for the insurance of the possible caused damages. Unless otherwise is stated on the website, the security deposit must be paid in cash. The amount of the security deposit is specified on each villa's homepage and in the check-in info email sent to guests 15 days before their arrival date. The deposit serves as a security for any damages that may occur in the villa, and the owner is entitled to use the deposit to cover the damage. If the damage caused exceeds the deposit amount, the guest is obligated to pay the total damage amount to the owner. If there is no damage to the villa, the owner is required to return the deposited sum to the guest at the time of key handover at the guest's departure.

13. DAMAGE


The guest is expected to be respectful of the rented villa. The guest is required to return the villa in the same condition in which he or she found it. In accordance with Clause 12 of these Terms and Conditions, the guest is directly liable to the owner for any caused damage, and the owner is entitled to use a security deposit to cover the sum of the actual damage. If the damage caused exceeds the deposit amount, the guest is obligated to pay the total damage amount to the owner. Intentional property damage or public order disruption is considered a serious breach of the Rental contract, and the owner and/or MY LUXORIA are authorized to terminate the Rental contract. The termination of the Rental contract shall be effective immediately, without notice, and the guest is obligated to leave the villa permanently, along with all other persons staying there, within 2 (two) hours. Guests are not entitled to demand a refund of the paid accommodation price from the owner or MY LUXORIA.

During the rental period, the guest is required to immediately notify the owner of any damage to the villa or property surroundings. The guest is required to examine the villa and the property surroundings with the owner prior to departure and before the return of keys. If there is no damage to the villa, the owner is required to return the deposited sum to the guest at the time of key handover at the guest's departure, in accordance with Clause 12 of these Terms and Conditions.

It is possible that the damage is also a need for additional cleaning as a result of the especially poor condition in which the guest returned the villa to the owner, and the owner is entitled to use the deposit to cover the cleaning expenses. MY LUXORIA is not liable for any damages caused to the owner or the guest if the deposit is not returned. All potential disputes between the owner and the guest must be resolved between them without the involvement of MY LUXORIA.


14. COMPLAINTS


If guests have any problems while staying at a booked villa, such as insufficient cleaning, damage, or other irregularities, they should bring it to the attention of the villa owner so that it can be resolved at the time. If the complaint is not fully resolved for the guest, the guest must contact MY LUXORIA directly by phone or email in order to resolve the complaint adequately. Written complaints should be directed to [email protected], no later than 3 days after the occurrence of damage or check out.

15. LOWEST PRICE GUARANTEE


MY LUXORIA guarantees that the accommodation price listed on the official website www.myluxoria.com is the lowest, i.e. that the same named villa cannot be found in advertisements at lower prices than ours. If the guest finds a more favorable offer for the same villa, in the same period, under the same conditions, and in the same currency than the price offered by MY LUXORIA and provides evidence of it to MY LUXORIA, the agency guarantees the conclusion of a Rental contract for the same villa, in the same period, and under the same conditions with an additional 5% (five percent) discount on the lower offered evidenced price. The evidence should have been sent before making a reservation with MY LUXORIA.

The lowest price guarantee does not apply if the price difference is due to an increase in tax or stamp duty or significant changes in the exchange rate. It is also not applicable if the lower prices on other web pages are not up to date and if the villa cannot be reserved at such prices, as well as in the case of special last-minute offers. The lowest price guarantee is only valid at the time of reservation and cannot be applied later or after the reservation was completed and paid for.


16. SPECIAL REQUESTS


If the guest has special requests that are not included in the accommodation price (such as cooks, waiters, special food, etc.), they will be fulfilled by the owner or a third party, if possible. Additional services must be announced in advance via email in order to be fulfilled in top quality, if possible. MY LUXORIA neither provides nor charges for additional services, but only assists in their arrangement, and MY LUXORIA cannot be held liable for the quality of services provided by third parties.

17. ACT OF GOD


In the event that the concluded Rental contract cannot be fulfilled or becomes significantly more difficult to fulfill due to an act of God (e.g. war, natural disaster, environmental disaster, epidemics, border closures, and similar act of God) that could not have been foreseen at the time of the Rental contract conclusion, MY LUXORIA and the owner may terminate the Rental contract, as neither MY LUXORIA nor the owner can be held liable in the above-mentioned cases.

18. COPYRIGHT


The website www.myluxoria.com contains copyright material, trade names, and other proprietary information, such as text, photos, graphics, and videos, among other things. The website's entire content is protected by copyright law. You are not permitted to change, publish, transmit, participate in the transfer or sale of, create derivative works from, or otherwise exploit any of the content, in whole or in part. You may only download information from the site for personal use. You acknowledge that by downloading copyright material, you do not acquire any ownership rights. We provide hypertext links to other people's websites. Using such a link means you are leaving our site, for which we accept no responsibility and make no warranties, guarantees, or representations in respect of these linked sites
